2.- INFORMATION
By accepting this Privacy Policy, the user (hereinafter the “User” or, when appropriate, the “Users”) is informed that the personal data he/she provides through the website located at the URL www.teka.com/global/ (hereinafter the “Website”), will be processed by TEKA, together with the data deriving from the User’s browsing and any other data he/she may provide in the future.
The User should read this Privacy Policy carefully. It has been written in clear and simple language to facilitate understanding, and the User may freely and voluntarily determine whether or not he/she wishes to provide his/her personal data to TEKA.
3.- COMPULSORY DATA
That data requested on the forms of the Website are, in general, compulsory (unless the required field specifies otherwise) in order to fulfil the purposes for which they are being collected.
Accordingly, if the data are not provided or are not provided correctly, it will not be possible to fulfil the User’s requests, notwithstanding that certain contents of the Website may be viewed freely.

- To manage registration of the warranty deriving from the purchase of a TEKA product: To manage registration of the product warranty by the User, and to carry out the performance of the services deriving from the warranty.
- To manage requests for product repairs: To manage and process requests for the repair of products acquired by the user and to perform the repair.
- To answer questions raised by the User through the enabled contact channels: To manage, process and respond to requests, incidents, complaints, claims or queries made by the User through the different communication channels made available to him/her.
- To conduct quality and satisfaction surveys: To conduct surveys of Users in relation to quality and their satisfaction with the products or services provided by TEKA.
- To manage promotional activities: To manage the User’s participation in competitions, prize draws and other promotional activities, and to manage the designation of winners and award of the prize.
- To send commercial communications to the User: To send commercial communication to the User on TEKA products and services, using electronic and/or conventional media, provided that the User has not expressed his/her objection in this regard, by marking the box provided for this purpose on the “Repairs” or “Warranties” forms, or when he/she has given his/her consent by marking the box provided for this purpose on the contact forms or other forms provided on the Website.
- To keep the User informed of TEKA’s news on Social Media profiles: If the User becomes a follower of TEKA on Social Media profiles, he/she will view the communications published by it. Any User who does not wish to continue receiving communications from TEKA on Social Media should stop following its profiles.
- To comply with legally established obligations: When the processing is necessary in order to comply with a legal obligation deriving from Spanish law or the law of the European Union that may be applicable to TEKA (tax legislations, for example).

- Contact details: e-mail address, telephone number and postal address.
- Other data: any data the User may provide.
- To conduct quality and satisfaction surveys:
- Identification data: name, surname and National Identity Document number.
- Contact details: e-mail address, telephone number and postal address.
- Goods and services transaction data.
- Other data: any data the User may provide.
- To manage promotional activities:
- Identification data: name, surname and National Identity Document number.
- Contact details: e-mail address, telephone number and postal address.
- Other data: any data that may be necessary to participate in the promotional activity.
- To send commercial communications to the User

- To keep the User informed of TEKA’s news on Social Media profiles: data relating to the User’s profile, as well as any clearly public data.
- To comply with legally established obligations: any data that may be legally required.
When the User provides data of third parties, he/she states that he/she has obtained the consent of such third parties and/or has sufficient authority to do so, and undertakes to convey to such third parties the information contained in the Privacy Policy, releasing TEKA from any liability in this regard.
However, TEKA may carry out the pertinent verifications to confirm this fact, by adopting the corresponding due diligence measures in accordance with data protection legislation.
6.- WHAT IS THE LEGAL BASIS FOR THE PROCESSING OF THE USER’S DATA BY TEKA?
The legal basis for the processing of the User’s data by TEKA is the performance of the contract between the parties, and, as the case may be, compliance with legal obligations and the consent sought, which may be withdrawn at any time. In particular, TEKA processes the User’s data by virtue of the following legal bases:
- To manage registration of the warranty deriving from the purchase of a TEKA product: The legal basis for the processing of data deriving from this purpose is the performance of the contract.
- To manage requests for product repairs: The legal basis for the processing of data deriving from this purpose is the performance of the contract.
- To answer questions raised by the User through the enabled contact channels: The legal basis for the processing of data deriving from this purpose is the consent which the User may withdraw at any time. If the User withdraws consent, it will not be possible to process the query or question raised.
- To conduct quality and satisfaction surveys: The legal basis for processing deriving from quality and satisfaction surveys will be the legitimate interest that TEKA, data controller, is acknowledged to have by the legislation.
This legitimate interest is based on being able to offer Users both the goods and services of TEKA, with the highest quality and best possible experience.
- To manage promotional activities: The legal basis for the process deriving from this purpose will be the consent that the user grants when accepting the legal terms and conditions of the promotion. In turn, the legal basis of the processing deriving from the designation of the winner and the award of the price is the performance of the contract.
- To send commercial communications: The legal basis for the processing deriving from this purpose when the User has provided his/her data through the “Warranties” or “Repairs” form will be the legitimate interest that TEKA, data controller, is acknowledged to have in the GDPR, while if the User provides his/her data through contact forms or other forms provided on the Website, the legal basis for the data processing will be the User’s consent.
- To keep the User informed of TEKA’s news on Social Media profiles: The legal basis for the processing deriving from this purpose will be the consent the User grants when becoming a follower of TEKA on social media./li>
- To comply with legally established obligations: The legal basis for all processing deriving from this purpose will be compliance with a legal obligation.
The consent obtained for the above-mentioned purposes is independent in each case and therefor the User may revoke consent for just one purpose without affecting the others.
7.- CONSERVATION OF DATA
The User’s personal data will be kept by TEKA throughout the following terms:
- Data provided to manage registration of the warranty on the product acquired by the User: the data provided to manage registration of the warranty on the product acquired by the User, and to perform the services deriving from the warranty, will be kept for 10 years. At the end of that term, the data will be kept blocked until any legal actions that may derive from the warranty become statute-barred.
- Data used to manage requests for product repairs: the data used to manage requests for the repair of products acquired by the User will be kept for 5 years. At the end of that term, the data will be kept blocked until any legal actions that may derive from the repair become statute-barred.
- Data used to answer questions raised by the User through the enabled contact channels: the data will be kept for the time necessary to process and respond to the request and, thereafter, until the legal actions deriving from the request become statute-barred.
- Data used to conduct User surveys on quality and satisfaction: the data will be kept for 3 months.
- To manage promotional activities: the data will be kept until the prize has been awarded and, once it has been awarded, until any legal actions deriving from the award come statute-barred.
- Data used to send commercial communications: the data will be processed for the aforesaid purpose until the User objects to the processing or revokes his/her consent.
- To keep the User informed of TEKA’s news on Social Media profiles: the data will be processed for the aforesaid purpose until the User stops following TEKA’s profiles on Social Medial.
- To comply with legally established obligations: The data provided to comply with obligations deriving from the services offered will be kept for the terms established by law.
8.- WITH WHICH RECIPIENTS WILL THE USER’S DATA BE SHARED?
The User’s personal data may be communicated to:
- Public Authorities, in the cases established by law, based on compliance with a legal obligation.
- Courts, in the cases established by law, based on compliance with a legal obligation.
- Companies that belong to the same group as TEKA, for administrative and business management purposes, based on the legitimate interest recognized in Recital 48 of the GDPR.
9.- COMMERCIAL AND PROMOTIONAL COMMUNICATIONS
One of the purposes for which TEKA processes the personal data provided by Users is to send them commercial communications with information on products, services, promotions, offers, events or news, relevant to the Users, as well as the TEKA Newsletter.
If the User wishes to stop receiving commercial or promotional communications from TEKA, he/she can ask to unsubscribe from the service by clicking on the link that will appear at the bottom of the commercial communications sent.
10.- USER’S RESPONSIBILITY
The User warrants that he/she is over eighteen (18) years old and that the data he/she provides to TEKA are true, accurate, complete and up-to-date. For these purposes, the User is responsible for the veracity of all the data he/she communicates and will keep the information provided suitably updated so that it reflects his/her actual situation.
Furthermore, the User warrants that he/she has informed the third parties whose data he/she has provided, if any, of the aspects contained in this document. He/she also warrants that he/she has obtained the authorization of such third parties to provide their data to TEKA for the purposes indicated.
In any case, the User will be liable for any false or inaccurate information he/she provides through the Website and for any direct or indirect damages that this may cause to TEKA or to third parties.
11.- EXERCISE OF RIGHTS
As data subject, the User may write to TEKA at the address indicated at the beginning of this Privacy Policy, or send an e-mail to: mail@teka.com, attaching a copy of his/her identity document, at any time and free of charge, to exercise the following rights:
a) Right of Access:
The User will be entitled to be informed by TEKA as to whether or not it is processing his/her personal data and, if so, the user may access such data and receive information on the purpose for which the data are processed, the data categories affected by the processing, the recipients to which his/her personal data were communicated and the planned time during which the data will be conserved, among other information.
b) Right of Rectification and Erasure:
The User will be entitled to request the erasure of personal data provided that the applicable legal requisites are met, and the rectification of inaccurate data concerning him/her when, among other reasons, such data are no longer necessary for the purposes for which they were obtained.
c) Limitations of processing, revocation of consent and total or partial objection to processing:
In certain circumstances (for example, if the applicant challenges the accuracy of his/her data, while the accuracy of such data is being verified), the User may request that the processing of his/her personal data be limited, which will only be processed for the purpose of defending claims.
The User will also be entitled to revoke the consent given and object to processing at any time, for reasons related to this/her particular situation, if the processing is based on our legitimate interest or on the legitimate interest of a third party (including any processing carried out for directly marketing purposes and the creation of the corresponding profiling). In this case, TEKA will cease the processing, unless it proves lawful reasons.
d) Data portability:
The User will be entitled to receive the personal data that he/she has provided to TEKA in a common, structured and machine-readable form, and to be able to transfer them to another data controller without this being hindered by the data controller to which the User provided the data, in the cases established by law for these purposes.
e) Automated individual decisions:
Furthermore, in addition to the rights mentioned above, where automated decision making takes place, including profiling, the User will be entitled to obtain human intervention by TEKA and to express his/her point of view and challenge the decision.
f) Others:
Furthermore, when personal data are transferred to a third country or to an international organization, the User will be entitled to be informed as to how he/she can access or obtain a copy of suitable guarantees related to the transfer.
The User may also submit a complaint relating to the protection of his/her personal data to the Spanish Data Protection Agency at C/ Jorge Juan, 6, 28001 – Madrid, when the data subject considers that TEKA has breached the rights acknowledged in the User’s favour by the applicable data protection legislation.
12.- SECURITY MEASURES
TEKA will process the User’s data in an absolutely confidential manner at all times and respecting the mandatory obligation of secrecy in respect of such data, in accordance with the provisions of the applicable legislation, adopting for that purpose the necessary technical and organization measures to assure the security of his/her data and prevent the alteration, loss, unauthorized access to or processing of such data, with regard to the state of the art, the nature of the data stored and the risks to which they are exposed.
13.- CHANGES
TEKA reserves the right to review its Privacy Policy when it considers it appropriate, in which case Users will be informed. For this reason, we ask you to check this privacy statement regularly to read the most recent version of TEKA’s Privacy Policy.
14.- ACCEPTANCE AND CONSENT
The User declares that he/she has been informed of the conditions concerning personal data protection, and accepts the content of this Privacy Policy.
